{"id":513,"date":"2004-07-11T00:00:00","date_gmt":"2004-07-11T00:00:00","guid":{"rendered":"https:\/\/newsroom.ferrovial.com\/press_releases\/resolucion-favorable-para-ferrovial-y-cintra-en-canada\/"},"modified":"2022-12-21T12:27:20","modified_gmt":"2022-12-21T11:27:20","slug":"resolucion-favorable-para-ferrovial-y-cintra-en-canada","status":"publish","type":"press_release","link":"https:\/\/newsroom.ferrovial.com\/es\/notas-prensa\/resolucion-favorable-para-ferrovial-y-cintra-en-canada\/","title":{"rendered":"Resoluci\u00f3n favorable para Ferrovial y Cintra en Canad\u00e1"},"content":{"rendered":"    <section class=\"wysiwyg text-editor \" id=\"\">\n        <div class=\"container container--narrow container--p-10\">\n            <p><strong><img loading=\"lazy\" decoding=\"async\" class=\"alignleft\" alt=\"\" src=\"\/wp-content\/uploads\/noticias\/img_logo_ferrovial.gif\" width=\"200\" height=\"86\" \/>El laudo emitido por un \u00e1rbitro independiente confirma que la Autopista 407 ETR no est\u00e1 obligada a solicitar la aprobaci\u00f3n de la Provincia de Ontario para actualizar las tarifas<\/strong><\/p>\n<p>El \u00e1rbitro independiente designado para dirimir la controversia en relaci\u00f3n al r\u00e9gimen de actualizaci\u00f3n de tarifas de la Autopista 407 ETR de Toronto (Canad\u00e1) ha emitido un laudo<\/p>\n<p>con fecha 10 de julio de 2004 en el cual se confirma que, de acuerdo con el contrato concesional, la entidad concesionaria no est\u00e1 obligada a solicitar la aprobaci\u00f3n de la Provincia de Ontario para proceder a dicha actualizaci\u00f3n de tarifas. Este laudo es susceptible de apelaci\u00f3n ante la Superior Court of Ontario.<\/p>\n<p>La decisi\u00f3n arbitral se produce en aplicaci\u00f3n de un procedimiento acordado entre la Provincia de Ontario y la autopista 407 ETR y supone la confirmaci\u00f3n de las posiciones mantenidas por la concesionaria y la ratificaci\u00f3n de la plena validez de la modificaci\u00f3n de peajes que entr\u00f3 en vigor el pasado 1 de febrero.<\/p>\n<p>El laudo del \u00e1rbitro independiente establece que:<\/p>\n<p>&#8211; La Autopista 407 ETR no requiere ninguna autorizaci\u00f3n ni aprobaci\u00f3n por parte de la Provincia de Ontario para proceder a la actualizaci\u00f3n de las tarifas<br \/>\n&#8211; El \u00fanico requerimiento que se establece para esta revisi\u00f3n es su comunicaci\u00f3n previa -28 d\u00edas antes- a la Provincia de Ontario<br \/>\n&#8211; El incremento de las tarifas efectuado el pasado 1 de febrero es v\u00e1lido y conforme al contrato de concesi\u00f3n<br \/>\n&#8211; La revisi\u00f3n de las tarifas del pasado 1 de febrero de 2004 no constituy\u00f3 un incumplimiento del contrato concesional.<\/p>\n<p>Cintra, filial de concesiones de autopistas de peaje de Ferrovial, es el mayor accionista de 407 ETR, de la que ostenta en la actualidad un 67,09%.<\/p>\n<p><strong>Resumen de los hechos<\/strong><\/p>\n<p>La Autopista 407 ETR de Toronto (Canad\u00e1) procedi\u00f3 con fecha 1 de febrero de 2004, y cumpliendo las prescripciones del contrato de concesi\u00f3n, a la modificaci\u00f3n de sus tarifas de peaje. Como consecuencia de esta modificaci\u00f3n, el Gobierno de la Provincia de Ontario -entidad concedente- dirigi\u00f3 un escrito a la empresa concesionaria que gestiona la autopista, manifestando su criterio de que la revisi\u00f3n de las tarifas necesita autorizaci\u00f3n previa de la Administraci\u00f3n, as\u00ed como que su modificaci\u00f3n sin autorizaci\u00f3n constituye un incumplimiento del contrato concesional.<\/p>\n<p>407 ETR consideraba que el r\u00e9gimen de la concesi\u00f3n no establec\u00eda que la autorizaci\u00f3n de la Provincia de Ontario fuera necesaria para la modificaci\u00f3n de las tarifas. Este criterio se basaba en los dict\u00e1menes legales recabados por la compa\u00f1\u00eda, constitu\u00eda la interpretaci\u00f3n compartida por todas las partes en el proceso de licitaci\u00f3n de la concesi\u00f3n en 1999 y, de acuerdo con \u00e9l, se hab\u00eda venido realizando en la pr\u00e1ctica las actualizaciones de tarifas de manera ininterrumpida desde entonces.<\/p>\n        <\/div>\n
